Terms of Service

These terms apply when you use the HospCreative website (hospcreative.com), hire HospCreative for services, or use HospTools, the software we run for clients. "We" means HospCreative, a business in McMinnville, Oregon, run by Clarke Hosp. "You" means the person or business using the website or our services. If you have a signed proposal or agreement with us, that agreement wins wherever it differs from these terms.
1. Using the website
You may browse and use this website for lawful purposes. Please don't try to break, overload or copy it, or use it to send spam. The content on this site is ours unless it says otherwise.
2. Our services and HospTools
- We provide the branding, website, automation and HospTools services described in your proposal, plan or invoice.
- HospTools works inside your HospTools (GoHighLevel) account and, when you connect them, other accounts such as Google Search Console, Google Analytics, Google Business Profile and ad accounts. It reads data to measure results and suggests or carries out the improvements described for each service.
- You stay in control. Actions that reach your customers or change your public listings start as suggestions you or we approve. Automatic actions only run after you turn them on, and some actions are never automatic (for example, spending above your caps or replying to low-star reviews). You can switch automatic actions off at any time.
3. Your responsibilities
- Give us accurate information, and only connect accounts you own or are allowed to share.
- Make sure you have the consent your customers need to receive your messages (for example, consent for text messages), and tell us about any opt-outs we can't see.
- Review and approve what needs your approval, and tell us if something we drafted is wrong.
- Keep your own account logins safe. We never ask for your passwords.
4. Fees and payment
Fees, billing dates and what each plan includes are set out in your proposal, plan or invoice. Subscriptions renew each period until cancelled. If a payment fails, we may pause services until it is resolved.
5. Ownership
- Your data and content stay yours, including your customer data and the material you send us.
- Work we create for you becomes yours once it is paid for, as described in your proposal.
- HospTools, our software, templates and methods remain ours. You get the right to use them while your service is active.
6. Privacy and confidentiality
How we handle information, including data from Google services you connect, is described in our Privacy Policy. We keep your business information confidential and only use it to provide our services.
7. Third-party services
Our services rely on third parties such as GoHighLevel, Google, Meta and Cloudflare. Their own terms apply to your accounts with them, and we are not responsible for their outages or changes. If a third party changes or removes a feature, we will adapt our services where we reasonably can.
8. Results
We work to improve your results, and we measure and report them honestly. We can't guarantee specific outcomes such as rankings, leads, reviews or revenue, because they depend on many things outside our control.
9. Limitation of liability
To the extent the law allows, our services are provided "as is", and our total liability for any claim is limited to the fees you paid us in the three months before the claim. We are not liable for indirect or consequential losses, such as lost profits. Nothing in these terms limits liability that cannot legally be limited.
10. Ending the service
You can end your service as described in your proposal or plan. When the service ends, we stop all automatic actions, you can remove our access to your accounts at any time, and we delete data from your connected accounts as described in our Privacy Policy. We may suspend or end the service if these terms are seriously broken.
11. Changes to these terms
We may update these terms. We will change the date at the top, and tell active clients about important changes before they take effect.
12. Governing law
These terms are governed by the laws of the State of Oregon, USA.
